RULES & REGULATIONS FOR ENTRY TO SRI KUALA LUMPUR

These are the Rules and Regulations for Enrolment at Sri Kuala Lumpur School (Primary and Secondary) which is a wholly owned entity of OTHMAN MERICAN EDUCATIONAL DEVELOPMENT BHD. This revised issue of the Rules and Regulations supersedes all previous issues in entirety and is subject to change without prior notice.

1 FEES & DEPOSITS
1.01 APPLICATION FEE
1.01.01 This is payable on application to join the School and must be paid prior to prospective students sitting for the entrance examination. This fee is strictly non-transferable and non-refundable even in the event that a prospective student does not sit for the entrance examination for any reason.

1.02 REGISTRATION FEE
1.02.01 The Registration Fee allows a new student, or a student going from Sri KL Primary School to Sri KL Secondary School, to take part in the enrolment process and must be paid before a prospective student can be offered a place at Primary School or Secondary School. This fee is strictly non-transferable and non-refundable (including in the instance where a place is offered but not taken up) except where the School is unable to offer a registered student a confirmed place.
1.02.02 A prospective student is only considered to have successfully enrolled in Primary or Secondary School once a place has been offered and has been accepted either in writing or by email within the specified time allowed in the offer letter.
1.02.03 Students from Sri KL Primary School who wish to enrol in Year 7 of Sri KL Secondary School must first register with the Secondary School and pay the Secondary School Registration Fee and shall further still be governed by the rules and regulations set out in section 1.04 and its sub-sections.
1.02.04 A student from Sri KL Primary School shall not be considered to have enrolled in the Secondary School until the Secondary School Registration Fee has been paid in full and if the Registration Fee remains unpaid by the due date then the student shall forfeit his/her right to register and enrol in the Secondary School.

1.03 TUITION FEES
1.03.01 Tuition Fees are paid by all students are strictly non-transferable and non-refundable.
1.03.02 The Tuition Fees for new students are payable on successful enrolment, that is, upon a place being offered and accepted.
1.03.03 Payment of tuition fees for all existing and newly enrolled students must be made, at the latest, ONE Calendar Month before the commencement of each School Semester/Term except for students who have enrolled later than this date.
1.03.04 A five percent (5%) surcharge will be imposed on all late payments.
1.03.05 Any returning student who has not paid his/her full fees plus late surcharge within 7 days after the start of the School Semester / Term will not be allowed to attend classes or any other School activities until the outstanding amount has been paid in full.
1.03.06 New students will not be allowed to attend classes or any other School activities until full fees are paid.
1.03.07 If the fees or any part of the fees including the 5% surcharge on late payments for any student have not been paid after 7 days from the due date as per sub-section 1.03.03 then the School reserves the right to terminate the student’s enrolment and offer the place to another.
1.03.08 If a student is terminated in accordance with sub-section 1.03.07 above, then his/her Security Deposit shall be immediately forfeited in entirety to the School without any refund along with the Registration Fee and any partial fees paid to date.
1.03.09 The off-setting, pro-rating and/or part-payment of Tuition Fees is strictly not allowed.

1.04 REFUNDABLE DEPOSIT
1.04.01 The Refundable Deposit is strictly non-transferable and payable in full on successful enrolment, that is, upon a place being offered and accepted. The deposit must further be maintained at its full amount two weeks before the commencement of each School Semester/Term.
1.04.02 If the Refundable Deposit is not paid in full before the due date, then the student’s enrolment shall be automatically terminated and all monies paid to date, including the Registration Fee, shall be forfeited to the School.
1.04.03 In the event that a student at any time is terminated or withdraws from the School after having enrolled but before having made payment of the required Tuition Fees, then the Refundable Deposit shall be completely forfeited to the School and the student and/or his/her parents shall have no claim or right to any refund.
1.04.04 If the deposit is not maintained at its full amount in accordance with section 1.04.01 then the student concerned shall not be allowed to attend classes or any other School activities until the deposit is restored to its full amount regardless of whether all other fees have been paid.
1.04.05 If sufficient notice of discontinuation of studies at the School is given, then the deposit will be refunded after all deductions of outstanding bills (if any) have been made.
1.04.06 A student may discontinue his / her studies at the School by giving a written notice of one complete School Semester/Term. For notice to be sufficient and therefore effective, fees for the said term must have been paid in full. Such notice is to be handed in personally or delivered by AR Registered Post to the Administration Office. An acknowledgement of receipt will then be issued.
1.04.07 The School is not considered to have received such a notice of discontinuation of studies if the same is not submitted by hand or AR Registered Post to the Administration Office.
1.04.08 In the case of a student leaving the school after Year 11 on completion of studies at Secondary School, no notice of withdrawal or discontinuation is required.
1.04.09 In the case of a student leaving school after Year 6 on completion of studies at Primary School, no notice of discontinuation of studies is required if the said student registers for Sri KL Secondary School before the closing date for Year 6 registration into Year 7.
1.04.10 A Year 6 student who remains silent on registration to Year 7 after the closing date for registration will automatically be deemed to have discontinued his/her studies at Sri KL and will not be reserved a place at Secondary School but shall be entitled to the return of the Security Deposit.
1.04.11 In all cases not otherwise covered by sections 1.04.07 and 1.04.08, the Security Deposit will be completely forfeited to the School if insufficient notice of discontinuation is given, if the full amount of tuition fees due remains unpaid after 14 days from the start of the academic term or if a student is expelled on disciplinary grounds.
1.04.12 Parents/guardians are required to surrender their original deposit receipt to the School before the Security Deposit can be refunded.
1.04.13 In the event of estrangement, separation or divorce, with regard to the return of the security deposit or any other monies owed to the account of a student, the School shall recognize the registering parent (ie. the parent signing the Registration Form) as the legally entitled recipient of such monies, unless otherwise agreed in writing by both parents or by court order instructing the same.
1.04.14 As a condition of enrolment at the School, the enrolling student and his/her parents/guardian hereby agree to contribute RM50.00 from his/her refundable deposit to the School’s Alumni Department (ATHENAEANS) which shall be deducted on the student leaving School.
1.04.15 The above deduction shall be made, notwithstanding any reason for the student leaving the School, including expulsion, early termination of studies or failure to join the School after paying the Registration Fee.

1.05 MODE OF PAYMENT – BY CHEQUE OR BANK DRAFT
1.05.01 Cheques and bank-drafts are to be made payable to “OTHMAN MERICAN EDUCATIONAL DEVELOPMENT BHD”. All payments MUST be made at the Administration Office which opens Monday to Friday from 8.00am to 4.00pm and Saturday from 8.00am to 11.00am except the first Saturday of each month when the office is closed. The Administration Office is closed for lunch from 1.00pm to 2.00pm and closed on Sundays and public holidays.
1.05.02 Out-station cheques will not be accepted without the relevant commission charges included and cleared on or before the due date.
1.05.03 Cheque payments by mail must be sent by AR Registered Post. The School does not accept responsibility for postal delays or losses and will impose the 5% surcharge on all payments received after the due date.
1.05.04 All returned and/or dishonoured cheques will be subjected to a five percent (5%) service charge (in addition to the 5% surcharge if payment is received late).

1.06 MODE OF PAYMENT – CASH
1.06.01 Cash payments MUST be made at the Administration Office during the office hours indicated in sub-section 1.05.01.

1.07 MODE OF PAYMENT - ONLINE, BANK TRANSFER
1.07.01 Payment of fees and deposits may be made by direct bank transfer or other online payment method, excluding credit/debit cards,  and should be accompanied by proof of payment to the School’s account and must show the details of the transaction with either the students’s FULL NAME and/or the relevant INVOICE NUMBER as space permits.
1.07.02 Any payment made online shall not be deemed to have been made until credited to the School’s account in full. Post-dated, delayed, incomplete and/or rejected payments made by direct bank transfer or other online payment method will be treated as payments due but unpaid and subject to the 5% surcharge on late payments.
1.07.03 The terms and conditions set out in sub-section 1.03 above shall wholly and specifically apply to late and delayed payments made by bank transfer or other online payment.

2 MEALS AT CANTEEN
2.01 Tea break and lunch are provided free of charge by the School.
2.02 Cash transactions are prohibited at the canteen except for the purchase of mineral water/sports drinks/hot drinks and other snack items before and after school hours that are approved by the School.
2.03 Only students with diagnosed food allergies or recognized religious dietary requirements may bring home-cooked food to eat during meal times after having obtained written approval from the Principal.
2.04 Parents/guardians of such students in sub-section 2.03 are strictly prohibited from bringing in food for students at any time of the day. Students with permission to eat home-cooked food are required to bring their meals with them at the start of the school day in clearly labelled containers along with cutlery as required to be stored in the staff room or canteen and collected at meal times by the students themselves.
2.05 All food brought onto the School compound should be free of pork and beef and generally selected with respect to the sensitivities of the community at large.

3 TRANSPORT
3.01 The School can introduce parents to independent bus operators approved by the School to transport pupils. Arrangements to hire their services should be made by parents themselves.
3.02 The School will not be responsible for any student left behind by the bus operators due to the student’s own negligence or otherwise.
3.03 The School, its management and its holding company shall not be liable for any accident, damage to property, injury or death resulting from the acts, negligent or otherwise, of any bus operator or third party outside the School compound.
3.04 The School shall be liable strictly only up to the limit of its accident insurance cover for any wilful or negligent acts by any approved bus operator or its employees and agents resulting in accident, damage to property, injury or death which occur in the School compound.
3.05 The School shall not be held responsible for any accident, loss or damage caused by any bus/minibus/car operator not licensed by the school whether inside or outside the school compound and parents making arrangements with unlicensed operators do so strictly at their own risk.

4 PARKING & VEHICULAR TRAFFIC
4.01 Parking space is limited and parents/guardians are required to follow guidelines issued in circulars from time to time and directions from School staff.
4.02 Failure to follow the directions of teaching staff, traffic wardens, security personnel or other authorised persons directing traffic will result in fines which will be invoiced to offenders. The School further reserves the right to take any action it deems appropriate against serious or repeat offenders which may include termination of enrolment without refund of fees or deposits at the School’s absolute discretion which shall be final and not subject to any appeal.
4.03 Failure to pay the said fines in section 4.02 within 14 days will result in the offender being denied vehicle entry to the School compound until outstanding fines are settled.
4.04 Parents and visitors driving through or parking in or around the School compound park strictly at their own risk.
4.05 Parents or other visitors who park in a place or manner that obstructs the free movement of other traffic or in a place reserved for staff, bus operators or other services will be liable to clamping and to pay a release fee, the amount of which shall be fixed at the start of each academic year and the proceeds of which shall be donated to charity.
4.06 Students whose family members, guardians or agents of the family (which shall include drivers, housemaids, taxi service providers, company employees and friends of the family) obstruct and/or slow traffic such that it causes a nuisance to other road users on any approach roads within fifty (50) metres of the School perimeter fence line shall be liable to disciplinary action. Such action may include termination of enrolment for persistent offenders without refund of tuition fees and/or deposits at the School’s absolute discretion which shall be final and not subject to any appeal.
4.07 With reference to sub-section 4.06, such obstruction or slowing of traffic shall expressly include but shall not be limited to double-parking any vehicle along the said approach roads whilst waiting inside the vehicle or leaving the vehicle unattended, cutting queue into another traffic lane, and/or ignoring the instructions of traffic police, MPSJ enforcement officers and/or Sri KL traffic wardens.

5 DISCIPLINE
5.01 The School reserves the right to take whatever necessary disciplinary action it deems appropriate against any student who breaches the disciplinary rules and regulations set out in the School Rules as applied to Primary School and Secondary School.
5.02 The School reserves the right to decide what are deemed to be breaches of the School Rules, to amend, add or delete offences on the list of offences and to take whatever disciplinary action it sees fit against students for offences that are not covered by the School Rules but warrant disciplinary action.
5.03 Disciplinary action for offences may include community service, caning, suspension from School and/or expulsion.
5.04 Clarification of the breaches of discipline can be obtained by referring to the School Rules which can be obtained at the administration office counter or by appointment with the Principal.
5.05 Students whose parents do not consent to any punishment for breach of the School Rules will be liable to termination of enrolment without compensation of refund of deposit or tuition fees and the School’s decision shall be final and not subject to any appeal.

6 PROMOTION OF STUDENTS
6.01 If a student’s academic performance is, in the opinion of the School, unsatisfactory, the School reserves the right to deny the student promotion to a higher Year for the next academic year.
6.02 Students are expected to score an average of 50% for all subjects before promotion can be granted. The School reserves the right to raise or lower this average score.
6.03 Students who are absent for more than 5% of the number of days in the academic year without valid reason may be denied promotion at the discretion of the School.
6.04 Students who withdraw from the School because they have not been promoted shall still be bound by all rules and regulations relating to refundable deposits and sufficient notice of termination of studies.

7 LIMITED LIABILITY & INSURANCE
7.01 The School holds insurance policies for accidents occurring on the School premises. However, parents/guardians are advised to take out their own comprehensive insurance cover for their children.
7.02 The School, its management and its holding company shall not be liable for any accident, damage to property, injury or death resulting from an act of God, unforeseeable circumstances and/or the acts, negligent or otherwise, of a third party within the School’s compound or the near vicinity.
7.03 The School shall be liable strictly only up to the limit of its accident insurance cover for any wilful or negligent acts by its employees and agents resulting in accident, damage to property, injury or death.
7.04 In signing their acceptance of the contents of these Rules and Regulations for Enrolment, parents/guardians hereby expressly and fully indemnify the School and its holding company against any accident, damage to property, injury or death resulting from their own wilful or negligent act or that of their children/ward, agents or guests.

8 CHANGE OF ADDRESS
8.01 The mailing address and contact/correspondence details (including email address) first given in the Registration Form shall be deemed to be the latest and most up-to-date details by which to correspond with students and/or parents.
8.02 Parents/guardians are required to inform the School immediately in writing whenever there is a change in these details. If the School is not notified of a change of mailing or email address, then it will not be held responsible for any correspondence that fails to reach parents/guardians.

9 CONDUCT OF STUDENTS & PARENTS / GUARDIANS
9.01 In the interests of setting a good example to students, the School requests that parents, guardians, relatives and associates (associates also meaning friends, house staff, agents of the family, etc.) of students conduct themselves in a reasonable and courteous manner at all times when on School premises or on school sanctioned activities outside of school.
9.02 The School reserves the right to request parents, guardians, students’ relatives and/or associates to desist from any unruly or discourteous behaviour and leave School premises, or any external location of a School sanctioned activity, immediately, if it is found that they are not or have not acted in such a manner as described in sub-section 9.01.
9.03 Parents, guardians or relatives of students whether outside or within the School premises are prohibited from engaging in any acts that are detrimental to the reputation of the School or affect to any degree the normal operations of the School.
9.04 The School reserves the right to deem what acts are detrimental to its reputation or affect its normal operations, but such acts may include :-
(i) Acting in a manner that may endanger the safety of students, staff and other persons within School premises.
(ii) Causing nuisance of any sort that may disrupt the ordinary running and business of the School.
(iii) Doing any business, distributing leaflets, fliers or material of any sort, soliciting signatures, canvassing votes or collecting funds for any purpose whatsoever without first obtaining official approval from the School.
(iv) Printing/broadcasting/circulating or causing to be printed/ broadcasted/circulated any images or written material, whether by traditional print media, internet, WhatsApp, sms, mms, social media application or any other electronic/virtual means, that sullies the good name of the School and/or is in any way defamatory/libellous of the School, its management or staff or other students.
(v) Sub-section 9.04 (iv) shall also strictly apply to students, and where it is reasonable to suppose that students and/or parents have instigated others not directly connected to the School to do such acts, then these students/parents shall be held liable as if they had done the acts themselves.
9.05 The School further reserves the right to request parents, guardians, relatives or associates of students to leave School premises immediately if it is found that such persons are acting or have acted in a manner detrimental to the School’s reputation or affecting normal School operations.
9.06 Such persons as have been requested to leave the School premises, and who fail to do so, shall be deemed to be trespassing and the School reserves the right to take any action against such persons as permitted by law.
9.07 The School further reserves the right to terminate the enrolment of students who themselves or whose parents, guardians, relatives or associates continue to engage in the activities described in sub-section 9.04 after receiving written and/or emailed warning from the School to stop such activities.
9.08 Students who have their studies terminated under sub-section 9.07 shall not be entitled to a refund of their tuition fees or security deposit.

10 BREACH OF RULES AND REGULATIONS
10.01 The School absolutely reserves the right to terminate the enrolment of students who themselves or whose parents/guardians are in breach of these rules and regulations without refund of deposits, tuition fees or compensation and such termination shall be final and not subject to any appeal.

11 CHANGES TO RULES AND REGULATIONS
11.01 The School absolutely reserves the right to delete, alter, and amend any of the rules and regulations stated here or to make new rules and regulations without notice.
11.02 Any alterations or additions to these rules and regulations shall be immediately binding on parents/guardians and students on being circulated to the same.
11.03 Any changes to these rules and regulations shall be considered to have been circulated to all parents by a copy of the revised Rules and Regulations For Enrolment being posted on any of the notice boards in and around the ground floor public areas of the School compound.
